Case Law
Employers' rights to monitor the contents of their employees' private electronic communications
Bărbulescu v. Romania
The Grand Chamber of the European Court of Human Rights, ruled on the 5th September 2017 in the case Bărbulescu v. Romania that companies can monitor their employees’ email if they are notified in advance, giving shape to a rapidly evolving area of the law at the intersection of technology, privacy and workers’ rights. In this case, the court decided that there had been a violation of Article 8 (right to respect for private and family life, the home and correspondence) of the European Convention on Human Rights. Mr. Barbulescu had “not been informed in advance of the extent and nature of his employer’s monitoring, or the possibility that the employer might have access to the actual contents of his messages,” it said in its ruling.
Never a dull moment at the offices of 21 Law! We just organised a seminar on Whistleblowing and the new Data Protection Regulations which was a great success, however we are already busy organising our next events. The annual event, I know a number of you look forward to attend is going to be held on the 22nd November 2017. I cannot believe it is the 9th year that Matthew, Andrew and I are organising this and I have no doubt that we will all have a great time learning but catching up too.
I have no doubt that the months ahead will be busy for those of you getting in line with the new Data Protection Regulations. If you need a hand we are here to help.
We will stay in touch as always and if you have any feedback including any ideas for workshops/event please do get in touch with us. We would love to hear from you.
Wishing you productive weeks ahead and we look forward to seeing you at our events soon!
