POWELL V. TAGAMI: AN EXPANSIVE INTERPRETATION OF PROBATE CODE SECTION 17211
 
Keystone analyzes a case that applies the fee shifting provision of Probate Code section 17211, this time against a beneficiary who brings bad faith objections to the trustee’s account. Here, the court not only charged the beneficiary for the trustee’s trust counsel’s fees, but also for the fees of the trustee’s personal counsel, who was separately retained to respond to charges of wrongful conduct against the trustee.
