RUTH BADER GINSBURG
1933-2020

Justice of the Supreme Court Ruth Bader Ginsburg was born in Brooklyn, NY, to Jewish parents with roots in Eastern Europe.  After studying at Cornell, Harvard, and Columbia, she taught law, and in 1972 joined the ACLU as the founding director of the new Women's Rights Project.  While there she carefully, strategically, and methodically argued a series of cases before the Supreme Court which recognized and addressed gender discrimination.  In a way which might seem surprising to us now, she started by arguing successfully that men's rights were infringed when spousal benefits were denied to the husband of a female Air Force officer (Fronteiro v Richardson), or when Social Security survivor's benefits were denied to a widower (Weinberger v Wiesenfeld).  She also served in the U.S. Court of Appeals.
 
After being confirmed to the Supreme Court in 1993 by a bipartisan vote of 96 to 3, the first Democratic appointment in 26 years, she tackled benevolent sexism–the idea that women should be protected from jobs or decision-making because of stereotypes about their ability–and wrote the decision which established a new standard of review for sex discrimination cases (US v Virginia).  She also wrote memorable dissents.  In the case of Lilly Ledbetter, a woman paid less than men for the same work at Goodyear Tire, the court ruled 5-4 against Ledbetter.  But Ginsburg's dissent moved Congress to action with the Lilly Ledbetter Fair Pay Act, which was the first bill that President Obama signed into law in 2009.  When the court decided in 2013 to gut the Voting Rights Act of 1965 because racial discrimination had decreased since the bill passed, she wrote in a memorable dissent: "[it] is like throwing away your umbrella in a rainstorm because you are not getting wet."  Sadly, as she foresaw, the decision led to Republicans closing more than 1,000 polling places in majority African American neighborhoods, purges of voter rolls, and strict voter ID laws designed to make it difficult or impossible for people of color, and Democrats, to vote.
 
Within two hours of the news breaking of Justice Ginsburg's death yesterday, Senate Majority Leader Mitch McConnell announced he would try and replace her immediately with a conservative, despite his unprecedented blockade of President Obama's nominee Merrick Garland for 293 days before the 2016 election.  For us, this raises the stakes of the election even higher: we must win the Presidency and the U.S. Senate to prevent the court tilting even further to the right.  We must apply maximum pressure to vulnerable Republican Senators like Susan Collins, Thom Tillis, and Lindsay Graham.  Our only hope to stop McConnell is if these people know the vote will cost them the election.  Sadly, a more right-wing court in November also increases the risk that Trump will try to interfere with the election by stopping counting before all mail-in ballots have been tallied, or persuading Republican state legislatures to disqualify Democratic delegates to the Electoral College.  Joe Biden needs a blow-out win, beyond any argument, in order to prevent these tactics from working.
 
If you've been hesitating to phone bank or text: I need you to come off the sidelines now and fight alongside me in the actions below.  I know those first couple of calls or texts can be intimidating, but it's just like riding a bike - you'll soon take to it.  You'll be surrounded by friends from HK Dems, work from a script, and get all the training and help you need.  And - best of all - you'll be on the comfort of your couch at home!  And in six weeks time, when the election is over, you'll be able to say: I protected Ruth Bader Ginsburg's legacy and fought for justice, dignity, and fairness for everyone.
